Entry Mechanic To enter this competition participants must:

2. Take a picture of you remixing the soccer celebrations with Refreshhh Mocktails and with your friends/family.

3. Post it to the Refreshhh social media platform you are entering on and tag us using on FB, Instagram and/or TikTok using hashtags #RemixAnywhere #RefreshhhMockatils

Participants need to follow the above to validate one entry. Participants can enter as many times as they would like.

Winner Selection a) Only valid entries that comply with Entry Mechanics will be considered;

Winner Notification Winner will be notified via the respective platform ( Instagram, Facebook, TikTok) as per the timings stipulated in the T’s & C’s

REFRESHHH COMPETITION GENERAL TERMS & CONDITIONS
1. Promoter
This competition is run by Refreshhh on behalf of The Beverage Company (Pty) Ltd, situated at 20 Anvil Road, Isando, 1609 (“Promoter”).
2. Acceptance of Terms
By entering the Competition, all entrants (“Participants”) agree to be bound by these Competition rules, terms and conditions (“T’s & C’s”).
3. Eligibility
This Competition is open to all citizens and legal residents of the Republic of South Africa who are 18 (eighteen) years and older, in possession of a valid South African Identity Document, and specifically residing in South Africa only. The Competition excludes shareholders, directors, employees, partners, agents, and consultants of The Beverage Company or the selected Promoters, or any other person who directly or indirectly controls, or is controlled by, the Promoters, or any supplier of goods or services in connection with this Competition, including their advertising agencies, and their respective employees, life partners, business partners, and immediate families (“Disqualified Persons”).
4. Entry Validity
Late and/or incomplete entries will not be accepted. Under no circumstances shall the Promoters, their associated companies, affiliates, or agents take responsibility for entries that are lost, delayed, or damaged in transmission. The entries reflected on the Promoter’s records will be treated as the only validation source and will be the only evidence of successful entries.
5. Application of General Terms
These General Terms apply to all promotional competitions unless otherwise specified in the Competition Schedule. In the event of any conflict, the Competition Schedule will prevail.
6. Winner Contact
The Promoter will make reasonable efforts to contact the Winner using the contact details provided for a period of 3 (three) consecutive days following the draw or Winner selection, or alternatively as determined in the competition-specific Schedule. This contact period may vary depending on the nature of the prize or Competition, and any changes will be clearly outlined in the specific Competition Schedule.
7. Notification
Winners will be contacted directly via their social media account or the relevant telephone number used to enter the Competition to obtain contact and delivery details, where applicable.
8. Forfeiture and Verification
If the Winner does not respond within the specified time or chooses to decline the prize, the Winner will forfeit the prize and a redraw will take place. Winners will be required to participate in an audit verification process and provide a copy of their Identity Document. The Winner’s name must correspond with their Identity Document, failing which official change-of-name documentation issued by the Department of Home Affairs must be provided. Failure to comply will result in forfeiture of the prize. Once the required audit verification has been completed, confirmed, verified and a winner acknowledgement is signed, where applicable then the Winner will be declared as an official Prize Winner.
9. Prize Fulfilment
Prize fulfilment will be arranged between the Promoter and the Winner within 6 (six) weeks of notification, in accordance with the Consumer Protection Act, where applicable.
10. Prize Restrictions
All prizes are strictly non-negotiable, non-transferable, and not exchangeable for cash.
11. Prize Substitution
The Promoters reserve the right to substitute the prize with another prize of comparable commercial value at their sole discretion. Prizes may be subject to additional terms and conditions in accordance with South African legislation.
12. Publication of Winners
The Promoter reserves the right to publish the names of Winners on media platforms, including but not limited to social media platforms, in-store displays where applicable, and relevant media publications. By entering the Competition, Participants grant express consent to such publication.
13. Publicity
The Promoter may make media announcements or publications of the Winner’s name and/or photograph. Winners may be invited to participate in publicity activities and may decline such invitations. No remuneration will be payable, and all publicity material will remain the property of the Promoters.
14. Additional Expenses
The Promoters will not be responsible for any additional expenses incurred by the Winner as a result of accepting or using the prize, whether foreseen or not.
15. Indemnity
Winners acknowledge that acceptance of a prize indemnifies and to the maximum extent permitted by law ,holds harmless the Promoters against any risks, dangers, or hazards associated with the prize or related activities, and any claims must be pursued directly with the manufacturer or sponsor of the prize, where applicable.
16. Monitoring
Participants may monitor the progress of the Competition on the Refreshhh social media platforms, where applicable.
17. Suspension or Amendment
The Promoters reserve the right to terminate, suspend, or amend the Competition due to unforeseen circumstances beyond their reasonable control or technical difficulties that may compromise the integrity of the Competition.
18. Audit
The draw or Winner selection may be audited by an independent third party.
19. Conduct
Any Participant who transgresses these terms, disparages the promotion or promotional brands, or acts contrary to the spirit of the Competition may be disqualified and banned from current or future promotions, subject to applicable law.
20. Fraud
Any unlawful, fraudulent, or dishonest conduct, determined at the Promoter’s sole discretion, may result in immediate disqualification.
21. Disputes
In the event of a dispute, the Promoter’s decision will be final and binding, and no correspondence will be entered into.
22. Limitation of Liability
Under no circumstances shall the Promoters or their associated parties be liable for any direct or indirect loss suffered as a result of participation in the Competition, except where such loss is caused by the Promoter’s negligence.
23. Defective Prizes
Any claims arising from defects related to prizes must be pursued directly with the manufacturer. All ancillary costs are the responsibility of the Winner.
24. Release and Indemnity
All Participants and Winners, to the maximum extent permitted by law, indemnify the Promoters against any claims arising from participation in the Competition or use of the prize.
25. Cash Prizes
The Promoters will not, under any circumstances be responsible for cash prizes paid into incorrect bank accounts or for reimbursement of case due to losses arising from theft or fraud.
26. Delivery Errors
Where incorrect delivery details are supplied or prizes are stolen as a result thereof, the Promoter will not replace or reimburse the prize.
27. Cancellation
The Promoters may cancel or amend the Competition for valid operational or regulatory reasons. Any material changes will be communicated in advance or as soon as reasonably practicable via the same channels used to promote the Competition.
28. Governing Law
These terms and conditions are governed by the laws of South Africa, and Participants consent to the jurisdiction of South African courts.
29. Personal Information
By entering the Competition, Participants acknowledge that the Promoter must process certain personal information for purposes as is necessary to administer, adjudicate, verify and fulfil the Competition, including the publication of the Winner’s name for transparency purposes in accordance with the Consumer Protection Act and Protection of Personal Information Act 2013 (Act No 4 of 2013).
30. Record Retention
The Promoters will retain personal information as required by law, including compliance with Protection of Personal Information Act 2013 (Act No 4 of 2013) and the Consumer Protection Act. Failure to provide the information necessary for lawful verification may result in forfeiture of the prize.
31. Data Protection
Personal information will be used in accordance with Protection of Personal Information Act 2013 (Act No 4 of 2013) and will not be disclosed to third parties without consent, except as required by law.
32. Marketing Consent
Participants consent to the use of their personal information for future marketing by the Promoters and shall have an option to opt out at any time. This Competition is not sponsored, endorsed, or administered by any social media platform.
